What states require claimants to notify them of settlements?

Several states require claimants to notify their insurers of settlements to give the insurer the opportunity to assert a lien.

The following states have notice requirements:

  • Florida
  • Georgia
  • Kentucky
  • Michigan
  • Minnesota
  • Montana

Keep in mind that even if you do not live in a notice state, it may be best for your attorney to notify your health plans of any settlements anyway, as long as the health plan is a private company and not Medicare, Medicaid, Tri-Care or the Veterans’ Affairs department.
