What is private healthcare? What is ERISA?

You may receive health and medical insurance coverage through your employment. If, as a result of your injuries, you have received medical care which your employee health plan paid for, the health plan may be entitled to reimbursement for those expenses from any settlement you receive. This is called subrogation or third-party reimbursement, and your employee health plan may place a lien on your settlement.

These types of employee plans are often referred to as ERISA. The Employee Retirement Income Security Act of 1974, or ERISA, protects the interests of employees and their beneficiaries who are participating in health and welfare benefit plans, and ensures that employees receive pensions and group sponsored health and welfare benefits promised by their employers.
