In terms of the rules for Medicaid, It is important to evaluate the recovery procedures and case law that affects the Medicaid agency’s right of recovery in your particular state. One state may require the Medicaid beneficiary to provide notice that there is a possible third party recovery. Another state may not require notice, but may still pursue the beneficiary for payment of a lien. Additionally, if you have received Medicaid benefits in multiple states for the injury-related care, you may need to reimburse each state.

You cannot ignore Medicaid liens. Medicaid recipients and their attorney(s) have a duty to cooperate in the Medicaid lien recovery process. Failure to cooperate may result in the denial of future benefits and possible legal action.
